These Terms of Service ("Terms") govern your access to and use of the Habita platform, including our website, listings, messaging features, and any related services (collectively, the "Platform"). By accessing or using Habita, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.

Habita is a platform that connects renters with property owners and agents. We do not own, manage, or operate any of the properties listed, and we are not a party to any lease or rental agreement between users.

Eligibility

You must be at least 18 years old to create an account or use Habita. By using the Platform, you confirm that you meet this requirement and that all information you provide is accurate and truthful.

Account Registration

To access certain features, such as listing a property or messaging an agent, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.

User Responsibilities

By using Habita, you agree that you will not:

• Post false, misleading, or fraudulent property listings

• Use the Platform for any unlawful purpose

• Harass, threaten, or mislead other users

• Attempt to bypass or interfere with the Platform's security features

• Scrape, copy, or reproduce content from the Platform without permission

• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these responsibilities, at our sole discretion.

Listings and Content

Agents and property owners who post listings are solely responsible for the accuracy of the information provided, including pricing, photos, availability, and property details. Habita reserves the right to review, edit, or remove any listing that violates these Terms or appears fraudulent, misleading, or inappropriate.

By submitting content to the Platform, including photos, descriptions, and messages, you grant Habita a non-exclusive, royalty free license to use, display, and distribute that content as necessary to operate the Platform.

No Guarantee of Transactions

Habita facilitates connections between renters and agents or owners, but we do not guarantee the outcome of any interaction, including whether a property is actually available, whether a lease will be signed, or the conduct of any user. Any agreements made between renters and agents or owners are strictly between those parties. Habita is not responsible for verifying the legal terms of any lease or rental arrangement.

Payments and Fees

Certain features, such as premium or featured listings, may require payment. All fees will be clearly disclosed before you complete a transaction. Payments are processed through third party payment providers, and by making a payment, you also agree to their applicable terms. Fees are generally non-refundable unless otherwise stated at the time of purchase.

Intellectual Property

All content on the Platform, including the Habita name, logo, design, and underlying technology, is the property of Habita and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform without prior written consent.

Third Party Links and Services

Habita may contain links to third party websites or services, such as payment processors or external agent profiles. We are not responsible for the content, accuracy, or practices of any third party site, and your use of such sites is at your own risk.

Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Habita does not guarantee that the Platform will be uninterrupted, error free, or completely secure. We make no warranties regarding the accuracy or reliability of any listing, agent, or user content.

Limitation of Liability

To the fullest extent permitted by law, Habita and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of income, or disputes arising between users. Our total liability for any claim related to the Platform shall not exceed the amount you paid to Habita, if any, in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold Habita harmless from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your infringement of any third party rights.

Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that harms Habita, other users, or the Platform's integrity.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. Continued use of the Platform after any changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Wilmington, Delaware.
